Who Can Charge You in Atlantic Beach

Most charges in Atlantic Beach come from the Atlantic Beach Police Department. The North Carolina Highway Patrol works speeding and DWI here as well, particularly on the bridge and along Highway 58.

You will see less of the other agencies here than on the mainland, but every statewide agency has jurisdiction on the island — including NC Alcohol Law Enforcement, Marine Patrol, and Wildlife Resources Commission officers. Which agency charged you still shapes the case, and it is the first thing we establish.

Coming down the bridge

Atlantic Beach connects to the mainland by the bridge from Morehead City, and that bridge is the front door to the island. Drivers come down off it carrying speed into a beach town, and speeding charges follow.

The beach bars

Atlantic Beach has several bars close to the water, and they are the origin of a large share of what we defend here — DWI, assaults, and alcohol-related charges, concentrated in the summer and at night.

After a day on the beach, or off a boat

Two patterns are specific to this town. People are charged with DWI after a full day drinking on the beach, and after coming in off a boat from a day of fishing. Neither fits the picture most people have of a DWI. Nobody set out for a night of drinking; they were in the sun for eight hours, or on the water, and drove home.

That matters to the defense, because the timeline of consumption is completely different from someone leaving a bar at midnight.

The beach itself

The beaches along this whole stretch of coast are patrolled for underage drinking. In Atlantic Beach that means a steady flow of charges against people who are otherwise having an ordinary day at the shore.

The beach music festival

Atlantic Beach hosts a beach music festival in May. Large crowds, sun, and alcohol produce the same cluster of charges every year. If you were charged that weekend, you were one of many.

How We Approach an Atlantic Beach Case

A DWI after the beach or off a boat. We look closely at when you were actually drinking and over how long. Hours in the sun, dehydration, and a slow day of drinking do not produce the same evidence as a short heavy session, and the State’s case is often built as though they do.

A speeding charge off the bridge. Depending on your record and the speed alleged, many of these can be reduced to a non-moving violation such as improper equipment — which keeps the insurance consequences of a speeding conviction off your record. That is usually worth far more over time than the difference in the fine.

Underage drinking. These charges land on young people who have never been in trouble, and the long-term consequences are far out of proportion to the night. There is usually more room here than people expect.

A charge from festival weekend. Crowded events produce unreliable accounts. Officers are managing a crowd, not an incident, and witnesses are strangers to each other.

A prayer for judgment. Many charges can potentially be resolved with a prayer for judgment continued, usually called a PJC. It is one of the more useful tools available for protecting a criminal record or a driving record, and it is something we look at early. It is not available for every charge or in every situation, but it is worth asking about before you assume a conviction is the only outcome.
